Publisher Sues for Return of Book Advances

An article for TheSmokingGun.com this week explained how New York-based publisher Penguin is suing a number of authors in order to get back the hefty advances those writers were paid. The advance is the money stipulated in the contract that the author will receive against the sale of the actual books; anything sold past the amount of the original advance then is shared with the author according to the contract details. The flipside of an advance is that the book may never sell enough to even come close to what the author was already paid, in which case the publisher takes a loss on the advance.

Penguin Books sues authors

But in the case of these authors, apparently they never got around to actually writing the books.

That would be interesting publishing news by itself, but what actually created the food for thought in that article were the comments from writers, agents, and publishers.

One point of contention in the comments’ section was that the article did not clarify whether the authors actually did not write the manuscripts or, as some commenters claim, the authors did submit manuscripts that the publisher then decided were not worthy of publication. While that distinction has not been made clear, there were several supporters for either the authors or the publishers based on that point alone.

Additionally, one literary agent from Trident Media Group made the best argument for having a literary agent that has been made in quite some time, stating that this is exactly why serious authors still need agents when working with a publisher, implying that any of Trident’s authors who were treated this way would be fully supported by the agency. He went on to state that no future manuscripts of his agency’s clients would be submitted to a publisher who treated its authors in this fashion.

But the most interesting discussions led back to how the publishing industry itself may be broken, a long-held stance that many people have taken in the advent of digital and self-publishing. Several independent authors weighed in on the discussion, some pointing fingers at the traditional publishing industry and how its business practices lead to situations like this, while others were slightly more supportive of the publishers, acknowledging that situations like this one won’t arise in self-publishing because an author can’t pay himself a $50,000 advance.

Best Bad Writing Contest — The Winner Is #FED_ebooks #author #indieauthor #writer

For three decades, the deeply silly Bulwer-Lytton Fiction Contest has challenged entrants to write the opening sentence to terribly bad books.

 The books aren’t real, but the best (bad) openers typically cram a whole lot of story into one convoluted phrase.

This year, a Texan won the romance category. Karen Hamilton of Seabrook wrote:

“I’ll never get over him,” she said to herself, and the truth of that statement settled into her brain the way glitter settles onto a plastic landscape in a Christmas snow globe when she accepted the fact that she was trapped in bed between her half-ton boyfriend and the wall when he rolled onto her nightgown and passed out, leaving her no way to climb out.

“One of my friends put a link on Facebook, and I thought, ‘Well, heck, why not?’ ”

Her winning sentence, she added, is in no way based on personal experience.

“No, I’ve never had a half-ton boyfriend,” she said Wednesday.

Instead, the phrase that kept running through her head – “I’ll never get over him” – became the seed of a long-winded pun.

Hamilton, 55, has earned accolades for her wordplay before, taking second place three years running at the O. Henry Pun-Off in Austin.

But these sorts of honors don’t come with a windfall of cash. When asked what she won for her winning sentence, Hamilton said: “Bragging rights and, apparently, an article in the Chronicle.”

The contest categories include adventure, children’s literature, crime, fantasy, historical fiction, purple prose, romance, science fiction, vile puns and western.

The overall winner was Cathy Bryant of Manchester, England, while another Texan – Bill Hartmann of Dallas – took runner-up in the crime category with:

“Chester and Harry, you don’t have the stomach for this, but Dick and I do,” the leggy blonde said in a throaty voice as she headed back in to finger – and hopefully nail – the brains and muscle of the strong-arm syndicate, the heel that gutted her niece.

The contest, sponsored by San Jose State University’s English department, takes its name from Edward George Earle Bulwer-Lytton, who wrote a doozy of an opener for his 1830 novel “Paul Clifford:”

It was a dark and stormy night; the rain fell in torrents-except at occasional intervals, when it was checked by a violent gust of wind which swept up the streets (for it is in London that our scene lies), rattling along the housetops, and fiercely agitating the scanty flame of the lamps that struggled against the darkness.

As the contest website points out, even Snoopy saw fit to plagiarize the first few words.

A Writing Exercise

In a single sentence, create a story idea with a beginning, middle and end. Examples:

Beginning – John goes to the bakery on the corner and encounters a friend from high school.

Middle – They have a conversation and reminisce the past.

End – Dramatic- She is the fatal instinct type and decides to kill him – or – he harbors old grudges and decides to kill her.

Romantic – they find in only a few short minutes that they were meant for each other, decide to divorce their present spouses and run away to join a circus or be the first couple married on the moon.

1. Invent your characters in one sentence as John walks to the bakery. He was overweight, short and balding but lovable like a bathtub squeaky toy.

He was tall, athletic and worked out – he’s going to the bakery to buy spinach blintzes damn it!

He is a professor of English Lit at Vassar and buys croissants for his ten-dollar latte.

2. Invent the dialogue. They argue over insults from the past.

She is witty and urbane – he is surly and dull or vise-versa.

They talk of good times from the past, smile and laugh a lot.

They discuss people they hated from the past and decide to become serial killers and take out the entire class.

3. Action/dialogue. Dialogue can be action if the descriptive narrative punches up the story.

Her sleepy green eyes found his through the candlelight as her dark auburn hair swirled over her bare shoulders when she turned her head. She purred, “I think we should disembowel them with a rusty can opener.”

His deep throaty laugh whispered an odor of mint julep. “I love it when you get kinky.”

Never forget that a sense of humor even with the darkest plots will catch the reader’s attention. Try to describe your characters in short punchy dialogue scenes. This will set your readers up for movie-type sequencing. Keep the reader glued to short beautiful narratives: From my story “Yah-Ko,” based on Native American shape-shifters:

“As if the mountain’s peak had pierced the sun, the glow spilled out like warm honey in golden ribbons over the lakes in the deep valleys. The osprey appeared as a silhouette against the sunset, a perfect curve in the wingtips teased the wind for more lift.”

I want you to write a short story under 1000 words using the formula above. I find short stories much easier to write and my novels are all based on short stories. It is great fun to open a finished short story and expand it to your heart’s delight – it can begin as a quick salad good for your brain and become a gourmet literary meal with seven courses of satisfying reading.

I never dreamed my book would be available world-wide

Sitting in my own little corner of the planet I had a head full of ideas.  I knew no one else had them.  They were the outcome of many years of research and what I believed to be original thinking.  They were also at odds in many ways with the orthodoxy in my own field.

We all have our dreams.  Mine wasn’t so much to become an author as to get a message across.  The message was a universal one in the area of health and healthcare and I just had to get it down into the written word.

I had previously self-published a book pre-internet days – local printer using old style type set and all that – and it finally served a very limited professional audience.  Next there came another book for which I engaged a self-publishing company and it cost a lot of money with very limited results.

 This time, and with a bit more research and lessons learned, the eBook seemed the way to go.  The cyber age was upon us and seemed destined to be the dominant player in the years ahead.  Not only was it simple to operate as a reader, even to senior citizens like myself, but by its very nature, it was to be available instantly anywhere in the world, be it Singapore, Sydney, New York or anywhere else in the English speaking world.

 For an author the publishing ramifications are also a relatively hassle free process.  I often compare this experience with my earlier ones and marvel at the differences but this time it was really important to me that my book would have a world-wide audience.  The whole purpose was in the message and so I kill two birds with one stone – be an author globally and get the message out globally.

 There are publishers and publishers, of course, and my one caveat is that the choice of publisher has to be well researched.  I spent a lot of time on this one and it proved to have been well worth the effort.

Did I ever think that as a science teacher I would write a book? The key that made it happen for me was teaching something that became a passion. Trite? I’m not sure about that. Passion is a word I often see connected to success.

Teaching forensic science at the high school and college levels dovetailed with my love of mystery books, and a childhood hero-worship of Nancy Drew. In fact, I market my books as Nancy Drew meets CSI, mystery stories for girls of all ages.

It all started in the high school library where I began to write case studies for my students, to make the science come alive through stories that included intrigue and sympathetic characters. The characters were so sympathetic that I decided to turn the plots and the characters of those case studies into my Annie Tillery Mystery series, The Madonna Ghost and Girl with Pencil, Drawing.

Producing the books required knowing how to write a book. I was not a trained writer. I found a writing course that met my requirements, and learned what I needed to know to get that story in book form.

Self-publishing had not yet exploded into the phenomenon it has become, so years went by before I screwed up the courage to publish.

The climate seemed right in 2009. I approached the self-publishing company I used at the time, and I began the process of submissions, revisions, editing, proof-reading, cover design, cover- copy and securing publishing rights. When that book was done I moved on to the next book with the same publisher.

Next came marketing. Marketing is a bear! New to this book business, I had no idea how much was out there by way of opportunities on the Internet. Signing up with First Edition Design Publishing was a no-brainer. It saved the time it would have cost me to get my eBook versions in so many different markets.

I am working on number three in my series, and am glad I self-published because it gives me lots of control over the entire process.

I’m digging deep into the world of marketing. I even do a program with another author about our journey through self-publishing, “So You Want to Write a Story?”  Social media, so important to anyone who markets, can almost be a full time job. There are also blog radio shows and local access TV.

When Tweeting, you must always be conscious of who your audience is and what they are looking for. Much of the writing that we do on social media and social networking hubs is very reader centric. While many may think this is some form of selling out, writing really is about both the writer and the reader. A writer must constantly keep their audience in mind.
